In attendance: Councilwoman Webb, Councilmen McNamara, Riley, Steel, Waniewski, Martinez, Craig, Ludeman, Collins, Copeland, Sarantou, Deputy Mayor Herwat, Mayor Bell.

Item 375 – Appointments – Board of Community Relations – confirmed – all voting yes.

Item 376 – Appointment – Investment Advisory Committee – confirmed – all voting yes.

Item 377 – Appointment – Lake Township JEDZ – confirmed – all voting yes.

Item 381 – Resolution – Recognizing Responsible Gaming Education Week July 30 – August 3, 2012 – adopted – all voting yes.

Item 402 – SUP for Charter High School at 600 Jefferson Ave. (Approved by committee 5 – 0)

* Steel – asked for determination of specific use of property – Convenience Stores and Adult Businesses in the area – no response.
* Herwat – Administration prepared to respond – did not get to you.
* Steel – Hold for two weeks.
* Craig – get answers from Plan Commission.
* Webb – depends on answer (her vote) - near Administration would be considered – two week hold.
* Ludeman – already moved to get going – near Huntington Center, Mud Hens Stadium. * Herwat – more than 500 feet from Adult Businesses.
* Webb – three Charter School coming up for a vote.
* McNamara – lets not get a head of ourselves.
* Steel - this is a radius issue.

Item 378 – Resolution – Accept petition for ESID for UAW building at 2300 Ashland Ave., $660,436, 14 years – adopted – all voting yes.

Item 379 – Determining to proceed with ESID for UAW building at 2300 Ashland Ave., $660,436, 14 years – passed – all voting yes.

* Representative – dropped the amount of assessment (he is hard to hear)

Item 383 – Expenditure to Lucas Soil & Water Conservation District for '12 contribution for programs, $19,200 – passed – all voting yes.

Item 384 - Amend TMC Ch. 2109, Toledo Police Command Officers Association (TPCOA), 2012 – 2014 Collective Bargaining Agreement – passed – all voting yes.

Item 385 - Amend TMC Ch. 2129, Toledo Police Patrolman's Association (TPPA), 2012 – 2014 Collective Bargaining Agreement – passed – all voting yes.

Item 386 – Agreement with Lucas County for Dog Warden services for 2013 (Amended) –

* Collins – received amendment, only goes to 2013 – thank you Administration – 67% of the revenue for the Dog Officer's (1.1 mil) Department is from Toledo – from Friday at 3 PM till Sunday at 4 PM, 9 hours of work (OT), cost $1200 – not justified - No calls after 11 PM – no 2nd Shift – cannot justify numbers to the State – you don't want the Dog Officers out – Regular Officers end up going to the call, then they call the Dog Officers, on OT – provide additional control – major step taken.
* Martinez – agrees with Collins – we are the customer - pay for a Cadillac and get a Yugo – will support this and need to find a compromise.
* Ludeman – getting 2nd Shift, easiest thing to do – get with Maumee and see what they do
passed – all voting yes.

Item 387 – Lease-purchase 6 EMS Transport Units for Fire & Rescue BLS transport service, $300,000/yr. For 3 years

* Webb – move forward with this

passed – all voting yes.

Item 388 – Encroachment (4'X12') into Jefferson Ave. for accessible ramp for former Secor Hotel at 425 Jefferson – passed – all voting yes.

Item 389 – Lease-purchase 2 bull dozers and 1 compactor for Hoffman Rd. Landfill, $173,000 Trust & Assessment – passed – all voting yes.

Item 390 – Purchase SUV, pickups, snow plows, roll off boxes & rebuild trucks for Landfill , $550,000/yr. For 3 yrs. - passed – all voting yes.

Item 391 – Contract for vendor to identify and obtain energy efficiency rebates from City buildings – passed – all voting yes.

Item 392 – Amend TMC Sec. 133.20 & 133.21 for division of Engineering Services under Department of Public Utilities – passed – all voting yes.

Item 393 – Contract with ET Electric to replace 2 streetlight poles on Greenbelt Parkway, $11,000 Assessed Services – passed – all voting yes.

Item 394 – Re-appropriation for ME Building curtain wall backup power at Bay View WWTP, $916,050 loan/S Rpt – passed – all voting yes.

Item 395 – SUP for K-3 Charter School at 4747 Heatherdowns Blvd., former Masonic Temple (Approved by committee 6 – 0)

* Steel – Approval quick response – 6 Convenience Stores within 1,000 feet – keep the stores away from the school – preclude school (2) – Rep. From Schools – Jefferson. Steel – do not substitute spacing requirements.
* Craig – it is up to the school, requirements can be waved – we cannot protect them from everything – the school can choose.
* Collins – schools exist, convenience store comes along, up to us to approve – there could be more spacing requirements – to prevent stores from coming in.
* McNamara – there was a little more to this.
* Steel – Entertainment District made to put minors in it? Does not think it would be wise for a school.
* Waniewski – it will be nice when this body doesn't shut down a business – stop playing moral police
* Ludeman – 5,000 kids leaving a Mud Hen's game during the day - what's the difference? They are going through these areas - agrees with Waniewski.
* Herwat – 5/3 field is in an Entertainment District.
* Martinez – night and daytime are totally different – would like to see more crosswalks.
* Riley – How many schools?
* Rep from Schools – Three schools.
* Riley – Are they in Entertainment Districts?
* Rep from Schools – yes.
Passed – Riley abstaining, rest yes.

Item 396 – Amend SUP to add a gym for K-12 Charter School at 2600 W. Sylvania Ave. (Approved by committeee 6 – 0) – passed – Steel, Webb, McNamara – no, Riley, Waniewski, Martinez, Craig, Ludeman, Sarantou, Collins, Copeland – yes.

Item 397 – Zone change at 535 Deardon Place (Approved by committee 6 – 0) – passed – all voting yes.

Item 398 – Zone change at 4529 W. Sylvania Ave. (Approved by committee 6 – 0) – passed – all voting yes.

Item 399 – Zone change at 2270 W. Laskey Rd. (Approved by committee 6 – 0) – passed – all voting yes.

Item 400 – SUP for elementary Charter School at 6149 Hill Ave., former Our Lady of Lourdes School (Approved by committee 5 – 0)

* Craig – several TPS Schools near Convenience Stores.
* Collins – stores are grandfathered in – this is in my District – no major change.
Passed – McNamara – no, rest yes.

Item 401 – SUP to add drive-thru to existing gas station/convenience store at 2445 W. Alexis Rd. (Approved by committee 5 – 0) – passed – Martinez – no, rest yes.

Item 402 (again) – started to vote, halfway through Craig called “point of order” instead of voting.
Vote on P.o.O. – yes – agree with point of order, no – you don't. Yes – Sarantou, Collins, Craig, Ludeman.
No – Riley, Waniewski, Martinez, McNamara, Steel, Copeland, Webb.
Failed – Abstaining – Riley,

Vote was 6 to 4 with Riley abstaining, Steel, Webb, Copeland, and Martinez no, rest yes. (since this was a special use permit, 7 yes votes were needed for approval) - measure failed

Item 403 – SUP for used car sales at 3215 W. Sylvania Ave. (w/o Recommendation 6 – 0) – Waniewski – have seen buffer – support – passed – all voting yes.

Item 404 – SUP for auto salvage operation at 4011 South Ave. (w/o Recommendation 6 – 0) - 1st Reading.

Last Call:

Riley – Administration – information on 1149 Grant St., doing business with District 1.

Webb – Sunday at 4 PM – Howard Pinkley, War of 1812 on Bridge (didn't catch which one) – Circus at Friendship Park on August 9th. Tickets at Senior Center and Rudy's Hot Dog.

Collins – Throwing figures around that don't add up. CIP, GF, and pension pick up. Needs Administration to address this.

Ludeman – Item 8 on abstention – not allowed – this needs to be addressed.

Martinez – Condolences to Cope family on the loss of their son.

McNamara – Abstention – don't know how to handle it.
